Warranty Issues


Accc are not a complaint authority, Office of Fair Trading and the Aust. Association of Caravans can only mediate but can't force either party to attend or heed advice. How do you get help when you buy a new caravan and after 4 months I have only used it for 3 days. Four repairers and the van leaks badly from all sides and windows. This has stopped our travel plans and I would like my money back. Any ideas please?

My understanding is that you should be able to get a refund according to the Australian Consumer Laws. Mention it to the provider and then court is the next step. Mention that you will all that the provider will have to pay your court costs if you win.

No-one, other than solicitors, wins at court so they may settle out of court when court is suggested.

Get yourself a lawyer. Prove you are dinkum. They will know they will loose and want to minimise their costs.
This is not a game for beginners.

Some friends of ours with major issues with a new van and getting the run around for nearly a year from the dealer, got a lawyer to send a letter explaining the dealers obligations and that court was the next step. They got their money back fairly quickly after that.
