The trailer ball mount can be left in the hitch receiver as long as it does not obscure the licence plate. To prevent theft Hayman Reese have a Hitch Pin Lock available which replaces the standard pin and clip. Alternatively you can remove the trailer ball mount and store it in a secure place and use a Hayman Reese hitch box cover to provide a neat finish on the towbar and at the same time stop dirt and water readily getting into the hitch receiver.
Pretty sure you can sill drive the vehicle with the WDH still attached. If parked and someone barks their shins on it, you may find it removed and left on the bonnet. Saw this happen one day and the marks on the bonnet definitely would not polish out.

Its illegal to drive a vehicle with a bicycle rack attached when not carrying a bicycle.
The same goes for towing mirrors when not towing anything.

To answer your original question again Jay, The attached Hitch is not essential when not towing, so it is illegal (as per Kebbins post) in Australia to leave in place when not towing. You also leave yourself open to some sort of action if someone is injured by it.
Other rules in 42.9.1 cover the design of the bumper bars, to prevent people being hurt if they come in contact with them.
Is the lock thru the securing pin or is IT the securing pin?
