There are a number of ways to resolve a problem on Ebay if you paid with Paypal you can lodge a claim but don't leave it too long as there is a time limit to lodge a claim.
I have found that most sellers on Ebay fall over themselves to resolve a problem as they can be prevented from selling on Ebay, if they have too many problems with buyers.
You are definitely covered by warranty when buying on Ebay.
So it is up to you to lodge a dispute against the seller as soon as possible
