I am going outside and I may be some time


Well it had to happen, I moved my car at a red light to let an ambulance pass and got pinged. I appealed and had the fine quashed but could not get the demerit points taken back of my unblemished licence which is a matter of great personal & proffesional pride. I am now sueing the  *********** for defamation, incompetence & "Failing to take due diligenge". I am being represented by a Man with a record of being able to get results and with whom I have come to an agreement re the fees - we loose he gets nothing we win he gets his fees paid and gets to keep 25% of any cash compensation....
I won't be around much as we go to trial next week which may apear strange because we already know the outcome the ****** a) tried to have the matter quashed and then as they were unsucsessful they b) wanted to settle out of court they then c) tried to bribe me with a generous exgratia payment as compensation but said that they could not remove the points from my licence but would provide documentation showing that the offence was not commited. We told them in what I thought was a most unambiguous statement that they could have sex with our footwear AKA "go R**t you're boots". Their response was that they had tried everything to correct this "problem" and offered more money, we responded that money was not the issue there is a principle here and  we are going to vigourously defend it and thanked them very much for their admissions of guilt and we'll se ya in court....
Of course this is not popular with a lot of my friends who suggest that I should just roll with the punches, turn the other cheek etc however if someone dosen't stand up to this sort of beaureaucratic garbage nothing will happen....
For once in my lousy life I'm on a winner...

You go for it Basil. Principle is very important, and at the end of the day, your demerit points are probably more valuable than a traffic infringement without conviction.
What a joke the powers that want to be have become!
They trip over themselves because the policies and laws are thrown into a ring, and it's a lucky pick to get the best 100. (That's my belief anyway).
Keep the bastards honest, and fight for what's right.
Too many people take the soft option, and let beaucracy have its way, without defending their rights. Right is might! They depend on people to cower from authority instead of standing up for themselves.

Try this, it should save your points.
When you pay the fine say it is $100.00 pay them $101.00 now they have to send you a check for $1, if you don't cash it they can't close the action or take your points, it's worth a try.

Can you give us the justification for the secrecy clause ?

 



They asked the Judge for that first up, I suspect for a few reasons 1) they knew they were going to loose, 2) to minimise the damage and humiliation that could be caused if I was to go to print and most importantly 3) I suspect that I AM NOT ALONE and this could set a precent for others, and why make it easy for them.....
