BE CAREFUL WITH WHOM LEAVE YOUR MOTORHOME ON CONSIGNMENT


Be careful with whom you leave your motorhome on consignment.  We left ours with one particular company, much to our regret.  We had advertised our 4X4 Sherwood motorhome privately, and were contacted by the original company that had sold it to us (2nd hand), offering to sell it on consignment. Their fee was reasonable, they had a buyer interested, and the contract said that final payment would be made to us within two weeks of the sale.  So we signed up in early July 2015.  The vehicle was sold mid July but when we hadnt received any payment by mid August, we started making enquiries of the company.  Despite multiple phone calls and multiple emails, we were always put off, calls never returned, emails never replied to.  I felt that we were being scammed. 

Concerned about this, we contacted the NSW Dept of Fair Trading, and found that the ATO had applied to wind up the company.  The Dept of Fair Trading therefore couldn't proceed further.  Further investigation by our solicitor found out that the ATO debt was repaid prior to the relevant court date.  We were able however to apply to become a substitute creditor in that action.  

It was only when the company received notification of our application that they eventually acted.  Payment was finally received in mid November, four months after it was due. 

The sum due was not insubstantial - $80,000 - and the stress was compounded by my having to undertake chemotherapy at the same time for bone marrow cancer.   We have since found out that another couple are in the same bind with the company this time the amount owing is $102,000.

So be warned!  Be careful.  Ask around.

It sounds like you got a real rough deal there Brian L,

I hope your lawyer also put in a claim for Interest on the balance owing.

A similar thing happened to us when we left N.Z,

We sold our house over there to an investor who didn't even see the house, the balance of sale price was set for settlement at a particular date, after we received a 50% deposit,

Well that time came and went, while we sat here in Perth waiting for the balance to appear, after a Month went by, I rang the Lawyer who was acting on our behalf, he told me that the purchaser had a problem raising the balance as he had it invested somewhere else,!!!

"Great I thought" I said that this really sucked, as we had ordered a new Caravan here and were waiting for the money to pay for it,

Things finally came good some three months later when the money appeared in our Bank, AND a nice surprise, an extra 10% on top of that,

Interest  add by our Lawyer,

Pays to get someone in the know, when there is a large sum of money involved,

A number of people have asked re the vehicle which was sold. It was a Suncamper.
The company had a new & 2nd hand sales yard quite near their factory at Thornleigh until quite recently.
They have since closed down the yard but still sell new, 2nd hand & on consignment from the factory.
