Please correct me if I'm wrong.....


G'day.

Friends decided to move their caravan out of the local caravan park. They were just week to week renters, but had been there for 12 months. Just prior to leaving, with all monies paid up, they were told that they would have to pay an extra $200, as they hadn't given notice of leaving. Am I missing something!!??

pipes, that sounds like a roughy to me. We have been permanents in a caravan park since Feb 1999, yes 16 years. We have seen people stay 1 day, 1 week, 1 year and many years but never heard of that one. If it was me, I would say stiff bickies sue me. It will only cost the park owners $1000 to introduce them selves to the lawyer.

Exactly, tell the greedy SOB's to go take a long jump.

Week by week is no contract, pay your weeks rent then leave, whether it is 1st week or 50th, no problem.

Unfortunately these two folk, apart from having some rather serious health problems, weren't "full bottle" on the c/van park rules. As a result, the owners bullied them into paying with threats of the law.

unless they have a written contract with the CP owners, they don't have a leg to stand on. Pay up until the final week and move. If the CP owners try to block them leaving by blocking them in, then your friends should call the police

Enough to say that the ownners of this particular c/v park are as well liked as the two who had the c/v park in the movie, "Red Dog".

Hitch up and leave, sounds like the CP has a cash flow problem and see you as the fatted calf. As long as you didnt sign a document stating the $200 will be paid upon leaving, cant see that though.

sounds legit to me .

he must have a clause , on "weekly basis" , that you give 1 weeks notice.

I might not like it , but if I had something to move on to.

If in NSW for that to happen they must of first signed a tenancy agreement. If the park rules state that a departure payment is required after 12 months and you signed them you may have a problem. Park Rules and a Tenancy Agreement are two separate documents. Go to the Dept of Fair Trading and lodge a complaint with the tenancy appeals tribunal.
The only grey area is that if you have been in a park for 12 months you can be deemed a permanent
