. Hi guys. Well, we had a win in the NSW Civil & Administrative Tribunal today, 14/5/15. The Dealer rep admitted they were wrong and mistakes made when registering our Esperance. Who said you can't fight them.
please check your vehicle weight and fight them if necessary.

There should be a law requiring dealers to provide a weighbridge certificate to include all standard and optional fittings/fixtures, dated within 5 days of sale of unit before concluding any sale. Not only on this site, but I have come across many people who are just to tired and stressed out to fight the issue of weight with dealers and manufacturers! If you have a case and can fight it by all means, do so and good luck. Yeah, I know, will never happen!!!!! buyer beware!

Hmm, I suspect there may be an aspect of this situation that may change people's opinion on the value of the win.
I know that many motor home builders work really hard to be able to put a plate on their van with a weight of less than the magical 4,500 Kg, some even go as far as selling a sub spec model with many things removed, or lighter versions used just to get that magical weighbridge ticket for a representative model, that they can then base their compliance plates on for the range.
They know that once they install the correct equipment, that the units are over weight, they also know that as soon as they become recognised as over 4,500 Kg, then their value will drop like a stone. They also know that it is unlikely that the motor home will ever be weighed.
Now the question is, do people want motor homes with all the space and equipment on board, as is offered today, or do they want to go back to the more basic units from the 90s.
Yes, MAYBE it was a win.
BTW, the same thing happens with vans, plating them down to suit tow vehicles with limited towing weights (example vans with 2,495 ATM, to suit the Prado), unlikely they will ever be used anywhere near that weight.
Hi Jenny & Barry. Yes I was compensated, and then some. They paid all costs for upgrade, increased rego costs for next 7 years, my wife's license upgrade to LR, weigh ridge tickets and 2 new batteries.
money is already in the bank and I pickup the batteries on Tuesday morning. If people have a weight issue, then fight for what you think is fair and right. I did.
the statistics say that 95% of people walk away. Are you, like me , in the 5% that won't?
Reading between the lines I guess you are happy with the outcomes. I am not a believer on another law as we probably have enough. I would suggest if any one was buying an RV of any kind you request a current weigh ridge certificate as part of the sales agreement. I would then test this certification and go to a local govt weighbridge, the one we have local gives a date/time stamp.
When I brought our MH I was very curious as to the weight so I went over the weigh bridge and was pleasantly surprised that I had 500kg to play with. I had full fuel & full water, I have since learnt that when the wife packs her wine in I could Be a little over.
i brought ours second hand it was 10 yrs old and I was the third owner so I did have system that would support any claims, so I guess it is back with being doing your research and being a little cautious.

our van gained tare weight by exactly 300kg from when it was reg'd by the Dealer and allegedly weighed and checked by the Dept of Transport and 3 months later when we decided to increase the ATM. The increase was not 299 or 301 - but spot on 300 kg and it was a regional govt weighbridge.
Seem some govt Inspectors must be well compensated at Xmas by various Dealers (and we stripped the 'van down to the same as when it came out of the Dealers yard)
