Simples!! If you have the phone in your hand you're busted. same as if you have those earbud things in both ears listening to music or a phone conversation so as not to hear a horn or a siren you're busted.

put it in a mount and you should be ok.

I know there's lots of things on regular 'exhibit' by motorists that, IMHO, certainly distract driver ability to react etc

and the use of handheld communication devices whilst in motion is but a small part of the total number...

I do agree they (along with DUI) seem to be the focus of law and require enforcement though...

My point is...if we are truly concerned with about 'capacity to concentrate, react to emergent situations, whilst driving' what about drivers

'putting on makeup' in the rv mirror;

chastising children in the backseat;

fumbling with their cigarette packet/lighter;

looking at newspapers/maps;

changing music selections in their audio player;

etc?????

The policeman would also find it difficult to determine what you are using the phone for. He would not be able to prove you were talking on the phone. All you would have to say "I'm using it as a GPS"

There are a lot of distractions when driving and a responsible driver will usually choose to attend to those distractions eg changing radio stations, yelling at the kids, when safety permits. I don't even have my phone handy these days when driving although I feel that some of the restrictions to be a bit over the top. Like when you have pulled over to the side of the road to use the phone, the engine has to be turned off.

I have been searching the internet for the Victorian law regarding using communication devices/CBRadio/UHF Radio/two-way radio in the vehicle. The only information I can find is in this link

However, it is silent on CBs etc.

I knew I had seen much discussion on using mobile phones vs CBs while driving so I searched the three forums I visit daily.

Each one confirms that all states have legislation/regulations/rules that cover hand held communication devices including mobile phones and each of the other States state the following in the regulations/rules regarding mobile phones - mobile phone does not include a CB radio or any other two-way radio.

Victoria is the only State that has no mention of CB or two-way radio. Therefore, I would suggest that, as there is no specific regulation/rule/penalty for using a CB/two-way radio in a vehicle it is legal to do so in Victoria. Obviously, vehicles registered in all other states (including EVERY truck) drive into and through Victoria, and do so without penalty.

Search through Google and all states make a statement similiar to this -

A driver can use a drivers aid such as a navigation device but it must be an integrated part of the vehicle design, or secured in a commercially designed holder, which is fixed to the vehicle.

So - don't use ya mobile for anything, including a GPS, or use a GPS unit unless it is secured as above.

Guess it is quite plain really
