The federal criminal code, updated through the Crimes Legislation Amendment (Telecoms offence and other Measures Act (No. 2) 2004, features offences of using a postal or similar service or a carriage service to menance harrass or cause offence.
WA Law Criminal Code (s338C-D and S338F) So if mental harm by harrasement is caused.
Penalties range from 18 months imprisonment to 8 years. WA has the highest penalty of any state.
Interesting: So if anyone sends a text that is threatening, and the wonders of technology provide the police dept with evidence, the sender can get more than a warning, Just thought I would post this up, Cyberbulling is getting worse, and its been proven that people that do this terrible thing are often cowards, and quite often unbalanced individuals. Peace out.

Yes I knew this was an offence and I said as much in the other thread about the nasty text. This person can get into some serious trouble. I know when I was with the QLD Police there were lots of young women and men coming into the police station really upset and showing their phones with these damn disgusting messages from friends, ex boyfriends or ex girlfriends etc. In some of the cases it was actually classed as stalking. Good luck with it Lynette.

Thanks to the true blues out there who have supported Howard and myself in the last 48 hours. I have decided after talking to the Police, that I will not be reporting this. We have taken on bowel cancer awareness seriously and have already saved 3 people (men) with early intervention advice. If they had not talked to us, they would be statistics. We are very proud of the work we do, and love helping people of all ages. One of our clients is only 7 years of age. Other than that, I would like to wish the persons who have upset us well.

Well posted Lyn, Although I would say that anyone ''Stupid'' enough to send such a Stupid Text, Would also be to ''Stupid'' to realise that they can, and should, have to be responsible for their Actions. So you just keep being the nice person you are, and don't get distracted by Stupid people, Ok !!

I can see why you and Billeee are mates Jules, real positive thinkers and the way to go!
I put Yeoeleven in that category too, a real positive thinker who knows how to turn a negative situation around!

You would all be good to be around Jules, some of the "positive" might rub off on those of us who need a more positive outlook
